Terms of Service

Plain-language summary

Migra Kreyol is a tool that helps you track your USCIS, EOIR court, and CBP I-94 immigration cases. We are JRICKSS Financial Services LLC. We are not a law firm and we do not give legal advice. Use the service for your own immigration matters or those of someone you legitimately help. Pay if you choose a paid plan; you can ask to cancel at any time. Refunds within 30 days if the service did not work as described. These Terms include an arbitration agreement and class action waiver (Section 15), with a 30-day opt-out. The full terms below cover everything else.

1. Acceptance of these terms

When you create an account, you must affirmatively accept these Terms of Service, and they form a binding contract between you and JRICKSS Financial Services LLC, a New Jersey limited liability company. If you do not agree, do not create an account or use the service.

Some public Migra Kreyol features may be used without signing in. Your use of those public features is subject to the rules of these Terms that by their nature apply to any use of the service, such as Section 5 (acceptable use) and Section 9 (not legal advice). Using a public feature without an account does not by itself constitute affirmative acceptance of the arbitration agreement or class action waiver in Section 15; those provisions apply only if you have affirmatively accepted these Terms.

If you are using Migra Kreyol on behalf of someone else (for example, a family member or a client at the law firm where you work), you confirm you have their permission and authority to do so.

2. About Migra Kreyol

Migra Kreyol is a case tracking tool for people with U.S. immigration matters. We let you save USCIS receipt numbers, EOIR alien numbers, and CBP I-94 numbers in one place; look up case status from official sources where the product offers a lookup; and receive notifications when something changes. The product shows the current availability and environment of each lookup; some functionality, such as USCIS lookups, may be limited until our production API access is enabled.

Migra Kreyol is not a law firm. We do not provide legal advice. We are not affiliated with USCIS, EOIR, ICE, CBP, the Department of Homeland Security, or any U.S. government agency. Information we display is informational only. The official government notice you receive in the mail or through an official portal is the document that controls legally.

3. Who can use Migra Kreyol

To create an account you must be 18 years of age or older and capable of entering into a binding contract. The service is intended for people in the United States and U.S. territories, although you may access it from elsewhere as long as your use complies with the laws that apply to you.

The service is not directed to children under 13. We do not knowingly collect information from anyone under 13.

4. Your account

You are responsible for the activity on your account. Keep your password private. Do not share your account with someone whose interests differ from yours. If you suspect someone is using your account without permission, change your password and email us at customerservice@jrickss.com.

You are responsible for the case identifiers (receipt numbers, A-numbers, I-94 numbers) you enter. Enter only identifiers that belong to you or to a person who has authorized you to track their case.

You may use Migra Kreyol to track your own cases or cases you are legitimately helping with. You may not:

We may suspend or terminate accounts that violate these rules. If your behavior could harm another user, we may act first and explain later.

6. Subscription plans and billing

Migra Kreyol offers a Free plan and paid plans (Pro, Solo Lawyer, Firm). Current plan details and pricing live on the Pricing page. Before you subscribe, the Pricing page states the price and that paid plans renew automatically; you provide billing information only after those terms are presented.

How billing works

Cancellation

You may request cancellation at any time by emailing customerservice@jrickss.com. When Stripe reports that your paid subscription has ended, your paid features end and your account moves to the Free plan. We will not charge you for future renewal periods after cancellation takes effect. Amounts already incurred or otherwise due before cancellation may still be collected.

30-day money-back guarantee

If Migra Kreyol does not work as described and we cannot fix it for you, we refund your most recent payment in full when you ask within 30 days of that payment. Email us at customerservice@jrickss.com with your account email and the date of payment.

Changes to pricing

If we change the price of an active subscription, we will give you advance notice before the new price applies to a future renewal, and you can cancel before it takes effect.

7. Your content and case data

Anything you enter, upload, or generate while using Migra Kreyol is your content. You keep ownership of it. By using the service, you grant us a limited, non-exclusive license to store, display, and process your content only as needed to provide the service to you. Examples: we display your case status back to you, we send notifications you opted into, we keep an audit trail of changes for security and your reference.

We do not use your content for advertising, AI training, sale, or any other purpose. See our Privacy Policy for details.

8. Our content and brand

The Migra Kreyol service, including the website, the dashboard, the browser extension, the brand, the logos, the copy, the design, and the underlying code, is owned by JRICKSS Financial Services LLC or our licensors. You may use the service as intended. You may not copy, modify, distribute, or create derivative works of our content without our written permission, except for normal use of the service.

9. Not legal advice, not a law firm

Migra Kreyol is not a law firm and does not provide legal advice or legal representation. Migra Kreyol does not select immigration forms for you, prepare immigration filings for you, or represent you before USCIS, EOIR, DHS, or a court. For legal advice about your immigration matter, use a licensed attorney or an authorized DOJ-accredited representative. Our information may be incomplete, delayed, or outdated relative to the official government record. The court notice or official USCIS letter is the document that controls legally.

We are not a notario. We do not fill out, review, or file forms for you, and we never charge for a form the government provides free. If anyone tells you they can get you a work permit or a green card faster for a fee, be careful. For immigration legal advice, use a licensed attorney or an authorized DOJ-accredited representative.

9.1 The asylum clock number is an estimate, and the projected number is a calculation

Two different numbers appear in Migra Kreyol and they are not the same thing.

A projection is a prompt to go check, never a statement of fact about your case and never a determination that you are eligible for anything. Before you file any form or rely on any date, confirm the current number with EOIR directly, and speak with a licensed immigration attorney or a DOJ-accredited representative. The official asylum clock is maintained by USCIS and EOIR, and only they can tell you what it is.

10. Service warranty disclaimer

We work hard to keep Migra Kreyol accurate, fast, and available. We cannot promise it will be perfect. The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted or error-free. We do not guarantee any outcome in any government process, and we do not guarantee that official systems, such as the USCIS Case Status API or EOIR, will be available or accurate; Migra Kreyol is an informational tool only. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

11. Limit of our liability

To the fullest extent permitted by law, JRICKSS Financial Services LLC, its officers, employees, and contractors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or lost goodwill, even if we have been told that such damages might occur.

To the fullest extent permitted by law, for any direct damages, our total liability to you for any claim arising from your use of Migra Kreyol is limited to the greater of 100 U.S. dollars or the amount you paid us in the 12 months before the event that caused the claim.

These limits do not apply to fraud, willful misconduct, gross negligence where applicable law does not permit its limitation, or any liability or statutory right or remedy that applicable law does not allow us to limit or that you cannot lawfully waive. Nothing in this section is a representation that these limits will be enforced in every jurisdiction or circumstance.

12. Indemnification

You agree to indemnify and hold harmless JRICKSS Financial Services LLC from third-party claims, losses, liabilities, and expenses, including reasonable attorney fees, to the extent caused by: (a) your unlawful use of the service; (b) your intentional violation of another person's rights, including looking up another person's case without authorization; (c) content or data you submitted without the right to submit it; or (d) your material breach of these Terms.

This section does not require you to indemnify us for our own negligence, misconduct, or violation of law.

13. How either of us can end this

You can stop using Migra Kreyol any time. Close your account from the dashboard or by emailing us. We delete your data per our Privacy Policy. If you have a paid subscription, account deletion cancels it first and then deletes the account; if the cancellation cannot be completed, we stop and tell you instead of deleting anything.

We may suspend or terminate your access if you materially violate these Terms, if your account is being used to harm someone, or if continuing to provide service to you would put us in violation of law. If we end your access, we tell you why unless the law forbids us from doing so, and we refund any unused prepaid period of a paid plan, except where you were terminated for fraud or for harming others.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a revised effective date. Material changes will apply prospectively, and we will provide any additional notice or consent required by applicable law. The "Last updated" date at the top reflects the latest version.

15. Governing law, arbitration agreement, and class action waiver

Please read this section carefully. It requires most disputes to be resolved through binding individual arbitration. That means you and we each give up the right to sue in court and the right to a trial by jury for covered disputes, and you give up the right to participate in a class action. You can opt out within 30 days (Section 15.5).

15.1 Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Federal law, including the Federal Arbitration Act, applies where it preempts state law. If you live outside New Jersey, this choice of law does not take away consumer protections that the law of your home jurisdiction grants you and does not allow to be waived by contract.

15.2 Talk to us first

Before starting arbitration or any legal proceeding, you and we agree to try to resolve the dispute informally for 30 days. Email customerservice@jrickss.com with the words "Notice of dispute", your name, the email on your account, a clear description of the problem, and what you want. We will do the same if we have a dispute with you. Most problems get solved here.

15.3 Binding individual arbitration, and what you give up

If we cannot resolve a dispute informally within 30 days, you and JRICKSS Financial Services LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or to Migra Kreyol will be resolved by binding individual arbitration, and not in court, except as stated in 15.6 and 15.7 below.

Arbitration is different from court: there is no judge and no jury; a neutral arbitrator decides the dispute, and the arbitrator's decision is final, with very limited review by courts. By agreeing to arbitration, you and we are each waiving the right to sue in court and the right to a jury trial for every dispute this section covers.

The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org, including the consumer fee protections in those rules; where those rules require us to pay filing, administration, or arbitrator fees beyond a capped consumer filing fee, we will pay them. The arbitration will take place in Essex County, New Jersey, or by phone or video if you prefer, or in the county where you live if you request it. A single arbitrator will decide. The arbitrator's award may be entered as a judgment in any court with jurisdiction.

15.4 Class action waiver

You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, collective, or representative proceeding, to the extent this waiver is enforceable under applicable law. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding. If a court decides this class action waiver is unenforceable as to a particular claim or request for relief, then that claim or request must proceed in court and is severed from arbitration, while all other claims remain in arbitration.

15.5 Your right to opt out, within 30 days

You can opt out of arbitration and the class action waiver, and keep your right to go to court. To do it, email customerservice@jrickss.com with the subject line "Arbitration opt-out" and include your name and the email address on your account, within 30 days of the date you first accept this version of these Terms. Opting out does not affect anything else in these Terms and will not affect your account or your access to the service in any way. If you opt out, disputes are resolved in the state or federal courts located in Essex County, New Jersey, or any other court with proper jurisdiction over the dispute.

15.6 What is not covered

Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also ask a court for an injunction or other equitable relief to stop unauthorized use or misuse of the service, or infringement of intellectual property, without first going through arbitration.

15.7 Rights that cannot be waived, and survival

Nothing in this Section 15 waives any right or remedy that applicable law does not allow to be waived by agreement. This section survives the end of your account and of these Terms.
