The asylum EAD clock is the 180-day waiting period before an asylum applicant becomes eligible to receive employment authorization based on a pending Form I-589, before EOIR or USCIS. It is not a calendar count: it stops and restarts, because applicant-caused delays do not count toward the 180 days. You may file Form I-765 under category (c)(8) 150 days after filing a complete asylum application. Can I do anything about it? Yes. Under the Garcia Perez v. USCIS settlement, approved September 26, 2024 by the U.S. District Court for the Western District of Washington, you may file an asylum EAD clock correction request. Immigration courts and EOIR's Office of the General Counsel must respond in writing within 25 business days of receipt, absent exceptional circumstances, and must give reasoning if they reject it. No. Under the Garcia Perez settlement, a granted change of venue no longer stops the asylum EAD clock in cases pending before EOIR. DHS published an interim final rule removing the automatic extension of employment authorization documents. Renewals filed before October 30, 2025 could still receive the up-to-540-day automatic extension. There are limited exceptions, including extensions provided by law and TPS-related Federal Register notices. It is proposed, not law. On February 23, 2026 DHS published a notice of proposed rulemaking, "Employment Authorization Reform for Asylum Applicants," that would extend the waiting period to file to 365 days, pause acceptance of initial (c)(8) applications when average affirmative asylum processing exceeds 180 days, and extend USCIS's adjudication timeframe to 180 days. The comment period closed April 24, 2026. As verified on 2026-09-14, no final rule has been published, so the 150-day and 180-day rules still apply.
